Gardner’s Stunt “Protections Don’t Go Far Enough”
It’s a new week, but Senator Cory Gardner is still airing his lie about pre-existing conditions on TV. CBS 4’s Shaun Boyd is the latest reporter to debunk Gardner’s 117 word bill and expose its shortcomings.
As Boyd reports, Gardner has repeatedly voted to repeal the Affordable Care Act, which could gut protections for people with pre-existing conditions. Boyd confirms what several fact checkers have already said about his political “fig leaf” – it “do[es]n’t go far enough” and “falls short” when it comes to protecting people with pre-existing conditions.

There is maybe no provision of the Affordable Care Act that is more popular than protections for people with pre-existing conditions. And that has created a predicament for Republicans like Senator Cory Gardner who has voted repeatedly to repeal the law.

His guarantee falls short. The bill says insurers may not impose any pre-existing condition exclusion, but it doesn’t say they can’t establish rules for eligibility that make it more difficult for sick people to qualify. It says they can’t factor health status into premiums, but it doesn’t limit premiums based on other factors like age. While they can’t exclude benefits for preexisting conditions or set limits based on preexisting conditions, they can refuse to cover certain expensive procedures for everyone, and set annual or lifetime limits overall. They may not be able to single out those with preexisting conditions, but they can design policies that are too expensive or don’t cover what they need. The one guarantee – insurers will exploit any loopholes.
